Terms of Service (Public Offer)

For the provision of proxy server rental services, mobile proxy servers, and dedicated servers on the Internet (hereinafter referred to as Services) to an individual, hereinafter referred to as the Customer, by IE Kotov G.S., hereinafter referred to as the Provider, collectively referred to as the Parties.
This agreement constitutes a public offer (hereinafter referred to as the Offer) and is equivalent to an "oral agreement." Acceptance of this Offer is by default the placement of an order on the website https://proxymania.su.

1. Terms and Definitions
Offer -- this document, published on the Website at the address https://proxymania.su/en/offerta
Website -- a collection of software for electronic computing machines and other information of the Provider on the Internet, accessible at the address https://proxymania.su
Order -- the result of actions performed by the Customer using the Website's software tools or other software provided by the Provider, reflecting the composition and list of services to be provided by the Provider.
Registration Data -- a list of mandatory information determined by the Provider, specified by the applicant when initially placing an Order for services, and available for subsequent editing by the Customer through the personal dashboard on the Website.
Account Credentials -- data provided to the Customer via email or through other software tools of the Provider for the purpose of obtaining access to services.
Personal Dashboard -- a section of the Website that allows the user to track the expiration date of services, renew them, and place orders for new services.
Login and Password -- unique data for accessing and using the services.
Email Spam -- mass distribution of information via email.
Brute Force -- the process of guessing passwords for accounts from specific databases.
Carding -- a type of fraud in which a transaction is carried out using a bank card or its details without the initiation of its owner.
Phishing -- a type of Internet fraud aimed at obtaining confidential user data.
Torrent Client -- an Internet protocol that allows downloading large files.
Payment System -- a cashless payment system using the Internet.
Online Banking -- the ability to remotely manage an account/card using the Internet.

2. General Provisions
2.1 The Services include providing the Customer with:

- access to the Personal Dashboard

- unique login and password allowing exclusive access to the services

- a list of proxy servers to which the Customer has access

- necessary consultations for connecting to the Services and configuring software via email, phone, or the technical support chat.


3. Rights and Obligations of the Parties
The Provider undertakes to provide the Customer with services during the term of the Offer, and the Customer undertakes to pay for these services in a timely manner.

3.1. The Provider is obliged to:

Provide the Customer with Account Credentials in a timely manner; Notify the Customer no less than 10 calendar days before any changes to tariffs or tariff plans via the Website and/or email; Maintain the confidentiality of the Customer's information obtained during registration, as well as the content of private email messages, except in cases provided by applicable law.

3.2. The Customer is obliged to:

3.2.1. Provide accurate registration data and update it in a timely manner.

3.2.2. Ensure confidential storage and prevent compromise of account credentials.

3.2.3. Immediately notify the Provider in case of loss or reasonable suspicion of breach of confidentiality (compromise) of account credentials.

3.2.4. Use the services in accordance with the terms of this Offer and applicable law, and not engage in the following activities:

- publication or transmission of any information the distribution of which violates applicable law or international law;

- publication, transmission, or viewing of pornographic materials;

- email spam and other types of spam;

- brute force attacks, carding, phishing, any types of hacking;

- using proxy servers for downloading via torrent clients;

- using proxy servers for payment systems and online banking;

- actions aimed at disrupting the normal functioning of Internet network elements (computers, other equipment, or software);

- actions aimed at gaining unauthorized access to an Internet resource (computer, other equipment, or information resource), subsequent use of such access, as well as destruction or modification of data on that resource.

3.3. The Provider has the right to:

3.3.1. In the event of any of the actions specified in clause 3.2.4, the Provider has the right to stop providing services without refunding the Customer;

3.3.2. At its discretion, engage third parties to perform the Agreement;

3.3.3. Change the cost and parameters of tariffs or tariff plans unilaterally no more than three times a year;

3.3.4. Suspend the provision of services during the term of this Offer for a period of no more than four hours per month for the purpose of scheduled technical maintenance of communication facilities and other equipment used for their provision;

3.3.5. Suspend, block, or prohibit the use of the Customer's software if the operation of such software leads or may lead to emergency situations, security breaches, or violations of the terms of service;

3.3.6. Suspend the provision of services in whole or in part if the load created by the allocated computing power, as well as incoming or outgoing Internet traffic, creates unacceptable conditions for the operation of the Provider's technical facilities or affects the quality, including security, of services provided to other clients of the Provider;

3.3.7. Refuse to provide services to the Customer without explanation, with a refund of all unused funds.

3.4. The Provider is not liable for:

3.4.1. The quality and uninterrupted functioning, availability of individual segments of the Internet maintained by third parties.

3.4.2. Any direct or indirect damages (including lost profits) caused to the Customer in connection with the use or inability to use the Services.

3.4.3. The availability of information posted by the Customer to all segments of the Internet, due to the specifics of the functioning of segments maintained by third parties.

3.4.4. Information posted by the Customer, operability of software installed without the participation of the Provider.

3.4.5. The operability and compatibility of software developed by the Customer or third parties.

3.4.6. Access by third parties to the Customer's confidential information, including account credentials, that occurred through the fault of the Customer, as well as the consequences of such access.

3.4.7. Any damage incurred by the Customer due to the disclosure of their account credentials by the Customer.

3.4.8. The accuracy of registration data provided by the Customer.

3.4.9. The operability of third-party software.

3.4.10. Any arbitrary software/database failures or errors generated by the software/database, as a result of which the Service was suspended or not provided in full to the Customer. In the event of timely notification by the Customer to the Provider of problems that have arisen, the Provider undertakes to resolve the issues and resume the provision of the Service as soon as technically possible. Notification is considered timely if made within 1 hour of the occurrence of the failure.

3.4.11. The Provider is not a defendant or co-defendant in the event that the Customer's actions cause financial, moral, or physical harm to third parties.

3.5. The Customer has the right to:

3.5.1. Require the Provider to provide Services in accordance with the terms of this Offer;

3.5.2. Require recalculation in case of interruptions in the provision of services or in case of services provided with reduced quality, in the manner provided by the Agreement;

3.5.3. Within 24 hours of receiving account credentials, request a refund or service replacement in the following cases:

- if the service was not provided

- if the service does not work and the Customer can confirm this with documentation (video, photo, logging)


4. Cost of Services and Payment Procedure

4.1. The cost of Services is determined in accordance with the tariffs published on the website https://proxymania.su. Service prices are listed in Russian Rubles (RUB).

4.2. Payments are made by the Customer through online banking or payment systems provided in the payment form on the Provider's website. No other payment methods are available.

4.3. The Provider has the right to unilaterally revise prices for Services and introduce new tariff plans. The Provider notifies the Customer of new prices via email.

4.4. Payment for Services is made on a prepaid basis.

4.5. The Customer is solely responsible for the accuracy of payments made. In the event of changes to the Provider's payment details, the Customer is solely responsible for payments made to outdated details.


5. Agreement Duration. Amendment and Termination Procedure

5.1. The Offer takes effect from the moment of publication on the Provider's Website and remains in effect until the Offer is withdrawn by the Provider.

5.2. The Provider reserves the right to amend the terms of the Offer or withdraw the Offer at any time at its discretion.

5.3. The Offer may be terminated by mutual agreement of the Parties.

5.4. For all matters not addressed in this Offer, the Parties shall be guided by the applicable laws of the Russian Federation.


6. Dispute Resolution Procedure

6.1. In the event of a breach of the terms of this Agreement by the Provider, the Customer is obliged to submit a claim no later than 7 (seven) days from the date of discovery of such breach. The Provider has the right not to consider claims submitted by the Customer after the aforementioned period. The Provider undertakes to respond to the Customer's claim no later than 10 (ten) business days from the date of its receipt.

6.2. If the Parties fail to reach agreement through the claims procedure, the dispute shall be referred to a court at the Provider's registered address.
